PARTICIPANT WAIVER, RELEASE OF LIABILITY, COVENANT NOT TO SUE & IMAGE RELEASE

Value Me Journeys

In consideration of being allowed to participate in any way in the above-referenced Value Me Journeys Journey Reality Experience (the “JRE”), related events, and/or activities, I acknowledge, appreciate, and agree that:

1. Risk Acknowledgment:

The risk of injury and/or death from the activities involved in the Value Me Journeys JRE and its related events is significant, including, but not limited to the following: (i) physical exertion; (ii) mental stress; (iii) emotional stress; (iv) contact with other participants; (v) contact with animals; (vi) potential vehicle-related accidents during travel to locations; (vii) exposure to unpredictable acts of nature including, but not limited to, weather conditions and natural disasters; (viii) exposure to potential hazards such as unsanitary conditions, harmful plants, insects, and animals; and (ix) the potential for permanent paralysis and/or death. While particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist;

2. Assumption of Risk:

I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation;

3. Compliance and Self-Removal:

I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual and/or significant hazard during my presence or participation, I will remove myself from participation and bring such hazard to the attention of the nearest official;

4. Waiver and Release:

I, for myself and on behalf of my heirs, assigns, personal representatives, and/or next of kin, forever WAIVE, RELEASE, DISCHARGE, and COVENANT NOT TO SUE Value Me Journeys and their officers, directors, representatives, officials, agents and/or employees, subsidiaries, and/or assigns, as well as their independent contractors, sponsoring agencies, sponsors, advertisers, volunteers, and if applicable, owners and lessors of the premises used to conduct the JRE (collectively, the “Releases”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, and/or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE. I further agree to indemnify, defend, and hold harmless Releases from any loss, liability, cost, claim, or damages arising from my participation in or association with activities and events organized and sponsored by Value Me Journeys or connected with the JREs.

5. Medical Fitness and Treatment Consent:

I attest and verify that I am free from all illnesses, injuries, and defects and that I am physically fit and sufficiently trained to participate in all activities associated with the JREs. My participation in activities and events organized or sponsored by Value Me Journeys is entirely voluntary.

6. Personal Property:

I acknowledge that organizers are not responsible for loss, damage, or theft of personal items during JREs.

7. Entry Fee and Refund Policy:

I understand that entry fees are non-refundable and non-transferable under any circumstances.

8. Event Modification Rights:

Value Me Journeys reserves a general right to postpone, cancel, or modify events in its sole discretion, including, but not limited to, situations where external factors might negatively affect the well-being, health, and/or safety of the participants.

9. Image Release:

I grant full permission to Releases, as described above, to use photographs, images, videotapes, motion pictures, recordings, or any other record of the activities of the JREs for any legitimate purpose in perpetuity, and I understand that I shall not be entitled to any compensation therefore.

10. Release of Recordings

I hereby grant permission gratis to the Releases to film, videotape, and record gratis my performance as it relates to the JRE and subsequently to telecast and otherwise utilize the same gratis in whatever manner Releases shall deem appropriate. Such permission shall include the unlimited right to appropriate use gratis by Releases of my name, image, likeness, voice, photograph, signature facsimile, and biographical information in connection with the JRE.

11. Acknowledgment of Adventure Levels:

I have been fully informed of the Adventure Levels and willingly consent to participate in higher-level experiences, fully understanding the associated risks and safety measures in place.

12. Additional Services Acknowledgment:

I am aware of the availability of narrative customization and the option for a digital memory book, which are designed to enhance the personalized aspect of my JRE participation.

13. General Release and Covenant Not to Sue:

I forever waive, release, discharge, and agree not to sue Value Me Journeys and its representatives for any injury, disability, death, or loss/damage to person or property, whether from negligence or otherwise.

14. Consent for Use of Photographic and Video Material:

I grant permission, without compensation, for the use of my likeness, voice, and participation in photographs, videos, and other recordings made in connection with JREs, for any legitimate purpose.

This Agreement signifies my comprehensive understanding and voluntary agreement to all terms outlined, recognizing the transformative potential of JREs and the commitment of Value Me Journeys to maintain a secure, respectful, and privacy-aware environment.
